何亚非大使在人权理事会国别人权审查工作组审议美国时的发言（英汉对照）

主席先生，

Mr. President,

中国代表团欢迎美国代表团刚才所做的介绍。中方注意到，美国政府近年来为促进和保护人权做出了一些努力，在普及医保、加强教育等方面取得一定进展。

The Chinese delegation welcomes the presentation just made by the US delegation. We have noticed that in recent years the US government has made efforts to promote and protect human rights, leading to some progress in the health care coverage and education.

同时，中方关切地注意到，美国关于人权保护的法律法规并不健全，仍未加入多部核心国际人权条约。美执法部门过度使用暴力，且缺乏独立的监督机制。美国内对穆斯林等少数族裔歧视现象严重，非洲裔、拉美裔和土著印第安人贫困率是白人的三倍。美司法机构滥用移民关押制度，部分州通过严重侵犯移民基本人权的法律。美国以反恐为名，监控、限制公民的言论自由和网络自由权利。

At the same time, we have also concerned by the gaps in the US laws protecting human rights and that it has not become a party to a number of core international human rights instruments. Its law enforcement agencies tend to use excessive force and it lacks independent oversight bodies. There is also serious discrimination against Muslims and minority racial groups, while the instance of poverty among Afro-Americans, Latinos and Indians is three times that of the white. The American judicial authorities have committed abuses under a system which allows for the detention of immigrants. Some states have enacted laws which gravely infringe upon the basic human rights of immigrants. In the name of fighting terror, the United States is also monitoring and curtailing its citizens' freedom of expression and the right to free internet access.

对此，我们有以下建议：

We have the following recommendations:

一、尽快批准《经济、社会、文化权利国际公约》、《消除对妇女一切形式歧视公约》、《儿童权利公约》、《残疾人权利公约》等核心国际人权条约。

1. Early ratification of the International Covenant on Economic, Social and Cultural Rights (ICESCR), Convention on the Elimination of All Forms of Discrimination against Women(CEDAW), Convention on the Right of the Child (CRC), Convention on the Rights of Persons with Disabilities(CRPD) and other core international human rights treaties.

二、加大监管力度，杜绝执法中过度使用暴力，特别是针对少数族裔的暴力，将违法者绳之以法。

2. Enhancing oversight with the view to ending excessive use of force by law enforcement agents, particularly when it is directed against racial minorities and bring perpetrators to justice.

三、尽快关闭关塔那摩监狱，并按照《联合国宪章》和安理会有关决议要求将恐怖嫌犯遣返回原籍国。

3. Quickly close down the Guantanamo prison and follow the provision of the UN Charter and Security Council resolutions by expatriating terror suspects to their countries of origin.

四、修改法律中有关歧视的定义，使之尽快与《消除一切形式歧视国际公约》等相一致，达到国际普遍认可的标准。

4. Modify the definition of discrimination in its laws to bring it in conformity with ICERD and other international standards.
